CMP No.1862 of 2025

The applicants initially joined as Junior Basic

Teachers. Subsequent thereto, they were appointed as Head

Teachers. Vide Annexures P-5 and P-6 benefits of FR-

22(I)(a)(i) have been denied to the applicants, in the case at

hand. Learned counsel on behalf of the applicants submits that

on the post of a Head Teacher, responsibilities are higher than

that of Junior Basic Teacher. In view thereof, he placed

reliance upon the judgment dated 05.05.2008, passed in CWP

No.124 of 2001, titled State of HP Vs. Ram Das Kaundal and

judgment dated 24.07.2010, passed in CWP No.1122 of 2010,

titled Narinder Singh Chauhan Vs. State of HP & Ors. In view of

the law laid down therein, impugned order dated 20.04.2022

(Annexure P-5) and letter dated 25.06.2024 (Annexure P-6),

are stayed during the pendency of the present petition.

Application stands disposed of.
